These Terms & Conditions (“Terms”) govern your access to and use of HomeOS Beta, a friends-and-family TestFlight beta operated by Patternmail.
By using HomeOS Beta, you agree to these Terms. If you do not agree, do not use the service.
## Beta service
HomeOS Beta is pre-release software. It is being made available for limited friends-and-family testing before public launch.
The service may be incomplete, experimental, unavailable, inaccurate, or changed at any time. Features, data sources, supported geographies, AI behavior, account tools, export tools, and deletion tools may change during the beta.
We may suspend, limit, or end the beta at any time.
## Eligibility and authorized use
You must be at least 18 years old to use HomeOS Beta.
You may only enter an address, upload materials, or request analysis when you have a legitimate purpose and the right to do so. For example, you should not use HomeOS Beta to investigate someone else’s home in a way that violates privacy, property, safety, or other rights.
You are responsible for the accuracy of information you provide and for keeping your account credentials secure.
## User content
“User Content” means information or materials you provide to HomeOS Beta, including documents, photos, notes, feedback, questions, messages, and other uploads.
You keep ownership of your User Content. By providing User Content, you give Patternmail permission to host, store, process, copy, analyze, summarize, display, and otherwise use that User Content as reasonably needed to operate, test, improve, secure, and provide HomeOS Beta.
You represent that you have the rights needed to provide your User Content and allow us to use it under these Terms.
Do not upload materials that are unlawful, harmful, infringing, invasive of privacy, or that you do not have the right to provide.
## HomeOS outputs and AI limitations
HomeOS Beta may generate summaries, answers, insights, timelines, suggestions, or other outputs (“Outputs”). Outputs may be based on public records, licensed data, User Content, AI systems, and other sources.
Outputs may be incomplete, inaccurate, outdated, or misleading. HomeOS Beta may miss important information or misunderstand materials. You are responsible for independently verifying Outputs before relying on them.
You may use Outputs for personal, non-commercial home understanding and organization, subject to these Terms. You may not present Outputs as professional conclusions or official records unless independently verified by an appropriate professional or source.
## No professional advice / no emergency use
HomeOS Beta does not provide legal, tax, insurance, real estate, engineering, appraisal, building-code, safety, medical, or emergency advice.
HomeOS Beta is not a substitute for licensed professionals, government records, inspections, engineering review, legal counsel, tax advisors, insurance professionals, appraisers, contractors, emergency services, or other qualified experts.
Do not use HomeOS Beta for emergencies. If there is an emergency, call 911 or the appropriate emergency service.
## Third-party services and data
HomeOS Beta may rely on third-party services and data sources, including public agencies, property data providers, address validation providers, mapping providers, AI providers, cloud providers, analytics providers, diagnostics providers, app stores, and other vendors.
We do not control third-party services or guarantee their accuracy, availability, completeness, pricing, licensing, or continued operation. Third-party terms and privacy policies may also apply.
## Acceptable use
You agree not to:
- use HomeOS Beta for unlawful, harmful, deceptive, abusive, or unauthorized purposes;
- enter addresses or upload materials without a legitimate purpose and appropriate rights;
- violate privacy, property, safety, intellectual property, or other rights;
- upload malware, harmful code, or disruptive content;
- attempt to bypass security, authentication, authorization, rate limits, or usage limits;
- scrape, crawl, harvest, reverse engineer, or bulk extract the service except as allowed by law or a written agreement;
- interfere with or disrupt the service or its infrastructure;
- copy non-public features, designs, outputs, methods, or materials to build a competing product;
- use Outputs to make automated legal, insurance, lending, housing, employment, eligibility, or other legally significant decisions about a person without appropriate human review and legal compliance;
- misrepresent your relationship to a home, account, or property.
## Intellectual property and feedback
HomeOS Beta, including its software, designs, interfaces, text, graphics, documentation, trademarks, and other service materials, is owned by Patternmail or its licensors and is protected by intellectual property laws.
Except for rights expressly granted in these Terms, we reserve all rights in the service.
If you provide feedback, ideas, suggestions, bug reports, or product comments, you allow Patternmail to use them without restriction or compensation to you.
## Fees, changes, and termination
HomeOS Beta is currently being provided for limited testing. We may later offer paid plans, paid features, usage limits, or storage limits. If paid features are introduced, we will present applicable payment terms before purchase.
You may stop using HomeOS Beta at any time. You may request account deletion by contacting homeos@patternmail.com.
We may suspend or terminate your access if you violate these Terms, misuse the service, create risk or legal exposure, or if we discontinue the beta.
## Disclaimers and limitation of liability
HOMEOS BETA AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATTERNMAIL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RELIABILITY.
WE DO NOT WARRANT THAT HOMEOS BETA WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPLETE, CURRENT, OR FREE FROM HARMFUL COMPONENTS. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PURPOSES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATTERNMAIL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, PROPERTY DAMAGE, PERSONAL INJURY, OR COST OF SUBSTITUTE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO HOMEOS BETA WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO PATTERNMAIL FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100.
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.
## Governing law / contact
Unless prohibited by law, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Before filing a claim, you agree to contact us at homeos@patternmail.com and try to resolve the dispute informally.
We may update these Terms from time to time. If we make material changes, we will provide notice through the app, by email, or by another reasonable method. The updated Terms will be posted at https://www.patternmail.com/homeos/terms.
